Subject: Reservation in promotion for persons with benchmark disabilities (PwBDs) regarding.

Mrs. Mr.

I am requested to inform you that the Ministry of Personnel and Training, vide OM No. 36012/1/2020-Estt(Res-II) dated 17.05.2022 and 28.12.2023, has issued guidelines and principles for reservation of promotions for PwBD employees.

2. Accordingly, by a letter bearing even number dated 18.06.2024, all the Postal Circles were requested to conduct DPC assessment, DPC being one of the modes of promotion, and to assess the suitability of PwBD candidates on the basis of LDCE already conducted, LDCE also being one of the modes of promotion. For extending the promotion in theory, the following was also communicated:

In case of promotion by DPC: the PwBD officer who is being promoted now will get a notional promotion if the date of his/her junior was promoted or 30.06.2016 whichever is later and if no junior was promoted then from the last date on which an officer was promoted in that vacancy year or 30.06.2016 whichever is later. However, the PwBD officer will get salary for the promoted post from the date of actual assumption of responsibility for the promoted post.

When promoted through LDCE: The PwBD officer being promoted now will get a notional promotion from the last date on which an officer was promoted on the basis of LDCE for that particular vacancy year or 30.06.2016, whichever is later. However, the PwBD officer will get salary for the promoted post from the date of actual assumption of responsibility for the promoted post.

3. DOPT also states the following in paragraph 8 of OM of 17.05.2022:

LIGHTENING OF THE FITNESS STANDARD:

“Where there are not sufficient number of PwBD candidates with benchmark disability available on the basis of the prescribed norm to fill up all the vacancies (in case of promotion through Limited Departmental Competitive Examination/Departmental Examination etc.) reserved for them. Candidates belonging to this category may be selected on the basis of relaxed norm to fill up the remaining vacancies reserved for them provided they are not found unsuitable for such post or posts. However, this eligibility determination shall not be used to grant any relaxation in the eligibility criteria laid down for the issuance of a certificate of benchmark disability.

The same relaxed norm should be applied to all PwBD candidates with benchmark restrictions irrespective of whether they belong to Unreserved/SC/ST/OBC category. No further relaxation in norm will be considered or allowed in favour of any candidate of any category”.

The above provision provides that in case PwBD candidates are not available within the normal prescribed norms to fill up the vacancies reserved for them, relaxed norms may be allowed to reduce the prescribed norms to fill up the vacancies reserved for PwBD. In view of this, it has been decided that qualifying marks/relaxed norms adopted for SC/ST in the departmental examination shall be extended to PwBD candidates to fill up the vacancies reserved for PwBD in case reserved vacancies could not be filled up within the normal prescribed norms.

5. Since the reservation is theoretically to be given from 30.06.2016, Circle/Directorate, if applicable, should calculate the vacancy which would be reserved for PwBD in the respective vacancy years. Vacancies so calculated and reserved for PwBD would be filled up within the normal prescribed norms on the basis of LDCE already conducted. In case reserved vacancies could not be filled up within the normal prescribed norms, qualifying marks/relaxed norms adopted for SC/ST candidates for the respective vacancy years should also be applied/adopted to fill up the vacancies reserved for PWBD

6. With regard to promotion based on seniority and suitability, paragraph 13 of the DOFT OM of 17.05.2022 states, among other things, the following:

“While filling up the reserved vacancies through promotion by selection, those PwB) candidates falling within the normal zone of consideration shall be considered for promotion. However, if there are not sufficient PwBD candidates of the concerned category available within the normal zone, the zone of consideration may be extended to five times the number of vacancies and the PwBD candidates falling within the extended zone may be considered for promotion.

6. Accordingly, vacancies reserved for PwBD in promotion quotas shall first be filled within the normal zone of consideration and in case reserved vacancies could not be filled within the normal zone of consideration, ZoC may be extended five times the number of vacancies to fill the reserved vacancies of PWBD.

7. Therefore, all Postal Circles are requested to take necessary measures as indicated in this brief dated 18th June 2024 and the functions explained above, for effective implementation and provision of reservations for promotions to PwBD employees.

8. Furthermore, the requested information regarding the creation of an additional post, as mentioned in the letter of 18.06.2024, can be provided immediately.
