Arik Air kicks out as Keyamo orders airline fleet grounding

The management of Arik Air (under receivership) has expressed its displeasure over an order by the Minister of Civil Aviation to ground a number of aircraft in its fleet across the country.

According to a statement issued and signed by the Chief Executive Officer of Arik Air (under receivership), Captain Roy Ilegbodu, the minister grounded the aircraft “without warning or consultation, which has serious implications for our valued passengers, dedicated employees and the broader Nigerian economy.

The development came as the Federal Airports Authority of Nigeria (FAAN) directed all airport operators in the country to assist the affected passengers while Arik Airline works out plans to rebook and transfer passengers to other available flights.

FAAN wrote in a statement made available to the media that the directive was given to all airport operators because the airport was aware of the grounding of Arik Air flights due to legal issues between the airline and its creditors.

A statement issued earlier by Arik Air CEO said: “Our priority has always been to connect people and facilitate trade, especially on critical domestic routes. The grounding of our fleet disrupts these vital services, leaving passengers stranded and increasing the already high cost of travel. This decision hurts everyday Nigerians who rely on our flights for business, family and essential activities.

“The decision also disregards ongoing legal proceedings. On February 26, 2016, judgment was rendered in favor of Atlas Petroleum International Limited and Engineer Arthur Eze. However, there is an ongoing case at the Federal High Court, where Asset Management Corporation of Nigeria (AMCON) is claiming its secured interest in Arik’s assets. Despite this, a writ of attachment was issued on July 18, 2024, targeting our aircraft, after which, following an original motion filed by AMCON, the FCT High Court on July 25, 2024, clearly directed all parties to maintain the status quo.

“We are therefore appalled by the grounding of our fleet, which exceeds the bounds of ongoing legal proceedings and court directives. We believe that this action undermines the rule of law and sets a dangerous precedent, whereby unprotected private interests are given priority over the public interest and the rights of preferential creditors. We are committed to following the legal process and have every confidence that the judiciary will resolve these matters fairly.

“Arik has always been a proud partner in Nigeria’s growth, providing reliable and safe air travel. We urge the authorities to reconsider this decision, lift the grounding orders and allow us to continue serving the public and supporting the economy.

We stand by our passengers and employees during this challenging time and are working tirelessly to resolve this situation. Your support and understanding are greatly appreciated. We sincerely regret any inconvenience caused to our valued passengers.”
